While Friedman Consulting, LLC professionals are not attorneys, there can be privilege with our clients through a Kovel Letter. The Kovel Letter describes our role and work to be performed in tandem with the attorneys. Named for the landmark 2nd Circuit case of Kovel v. Commissioner, the Kovel Letter is the formal engagement letter between an attorney and accountant. First the client will engage the services of a law firm who, in turn, will engage our services. Thus, any subsequent discussions with Friedman Consulting, LLC are protected under attorney-client privilege. On the other hand, your CPA firm cannot have the benefit of privilege under a Kovel Letter because their services are discoverable.
Why would you ever need a litigation consultant like Friedman Consulting, LLC?
Attorneys use consultants in litigation for the same reasons that businesses retain consultants as advisors. Lawyers need quality advice when litigating, and we offer this service because we have experience in pragmatically advising companies with their problems in the business world. The law firms we consistently work with understand and respect this practical experience. Because accounting is the language of business, accountants can often clarify business transactions and explain the records reflecting them to lawyers, judges, and the jury in language they can understand.
